1. Acceptance of Terms

By downloading, installing, or using Nomad Days ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Christian Schafmeister ("we", "us", or "our").

2. Description of Service

Nomad Days is an iOS application designed to help users track their country stays. The App provides:

• Manual stay entry with country, dates, notes, and attachments
• Calendar view with visual country indicators
• Dashboard with statistics and current location
• Journey timeline of your travels
• Insights and statistics about your stays
• Optional automatic country detection via location services (Pro version)
• Data export to PDF and CSV formats (Pro version)

The App stores all data locally on your device. We do not operate servers that store your personal data.

3. User Responsibilities

As a user of Nomad Days, you are responsible for:

• Maintaining the accuracy of your stay records
• Regularly backing up your data using the export feature
• Understanding that deleting the App will permanently erase all local data
• Using the App in compliance with applicable laws
• Consulting qualified professionals for tax, legal, or visa advice

5. Purchases and Subscriptions

Nomad Days offers a free version with limited features and a Pro version available as a one-time in-app purchase.

• All purchases are processed by Apple through the App Store
• Prices are displayed in your local currency within the App
• The Pro upgrade is a non-consumable purchase (one-time, yours forever)
• Refunds are handled by Apple according to their refund policy

For refund requests, please contact Apple Support directly through the App Store.

6. Intellectual Property

The App, including its design, code, graphics, and content, is owned by Christian Schafmeister and protected by copyright laws.

You may not copy, modify, distribute, sell, or lease any part of the App without explicit written permission. You may not reverse engineer or attempt to extract the source code.

Your data (stay records, notes, attachments) remains your property. We claim no ownership over user-generated content.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Christian Schafmeister shall not be liable for:

• Any direct, indirect, incidental, special, or consequential damages
• Data loss resulting from app deletion, device failure, or software defects
• Tax penalties, visa denials, or legal issues arising from reliance on the App
• Inaccurate location detection or GPS errors
• Service interruptions or app unavailability

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Mandatory statutory liability — in particular for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act (Produkthaftungsgesetz) — remains unaffected.

8. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Christian Schafmeister from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App or violation of these Terms.

9. Termination

You may stop using the App at any time by deleting it from your device.

We reserve the right to terminate or suspend access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last Updated" date and, where appropriate, through App Store update notes.

Your continued use of the App after any modifications indicates your acceptance of the updated Terms. If you do not agree to the new Terms, please stop using the App.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

Mandatory consumer-protection provisions of your country of residence remain unaffected. To the extent permitted by law, the place of jurisdiction for disputes arising from these Terms or your use of the App is Düsseldorf, Germany.
